Terms and conditions of sale

1. Who you are buying from

2. What we sell

Downloadable digital files, with no physical medium: preset banks for software synthesisers, MIDI files, and sample packs in WAV format.

The exact contents of each product, the number of files and their formats are described on its product page. Those are the essential characteristics of the product.

3. What you need to use the files

This is a condition for the product to work at all, not a detail. Read it before you buy.

The files carry no technical protection measures: no key, no activation, no connection required. They open with the programs listed above and nothing else.

We do not warrant that the files work with a version of Serum earlier than 2.1.5, or with a program that reads neither WAV nor MIDI.

4. Price

The price of each product is shown on its product page, in euros, VAT included.

Because the product is delivered as a download, there are no delivery charges. The price shown is the final price.

No price is personalised by automated decision-making. The price shown is the same for every buyer.

5. Payment

Payment is made in full at the time of the order, by card, Apple Pay, Shop Pay or PayPal. Payments are processed by Shopify Payments.

The order is binding once payment is accepted.

6. How you receive the files

Immediately after payment, if you have given the consent described in section 7. You receive a download link by email, at the address given with your order.

The number of downloads is not limited. If a link does not work, write to us and we will send it again.

If you do not give the consent described in section 7, the files are made available to you at the end of the 14-day withdrawal period.

7. Your right of withdrawal, and how you waive it

You have 14 days from the conclusion of the contract to withdraw, without giving a reason and without penalty (article L221-18 of the French Consumer Code).

However, this product is digital content supplied without a physical medium. For the download to start straight away, the law requires us to ask you for two things before payment, by way of a box that you tick yourself:

• that you expressly request performance to begin immediately,
• and that you acknowledge that you thereby lose your right of withdrawal.

Once you have accepted both and the download has begun, the right of withdrawal is extinguished (article L221-28, 13° of the French Consumer Code). We confirm this to you in writing in your order email.

As long as you have not ticked that box, or as long as the download has not begun, your right of withdrawal remains fully intact.

How to withdraw, while the right is still open. Three ways, all free of charge:

1. the "Cancel your contract here" page on this website, available throughout the period;
2. the model withdrawal form, published on this website and attached to your order email;
3. any other clear written statement sent to hello@sendreturnstudio.com.

We send you a time-stamped acknowledgement of receipt and refund the full price within 14 days, using the payment method you used for the order.

No return costs: there is nothing to send back, the product being a file.

No charge at all falls on you if you withdraw, including where the download had begun without you having ticked the box.

8. If the product is faulty or does not match its description

We owe you the legal guarantee of conformity under articles L224-25-12 and following of the French Consumer Code, and the guarantee against hidden defects under articles 1641 and following of the French Civil Code.

For digital content supplied in a single act, the legal guarantee of conformity runs for two years from delivery.

In practice: if a file is missing, unreadable, corrupted, or does not match what the product page describes, write to hello@sendreturnstudio.com quoting your order number. We repair, replace or refund, your choice being between bringing the content into conformity and, where that is impossible, a price reduction or termination of the contract.

These guarantees are free of charge and independent of the right of withdrawal in section 7.

We offer no commercial warranty on top of the legal guarantees.

9. Duration of the contract

The contract covers a single transaction and ends when the files are supplied. There is no subscription, no minimum term, no automatic renewal and nothing to cancel.

The licence that comes with the product is, by contrast, perpetual: it does not depend on an active account or on continued access to this website.

10. Deposits and financial guarantees

None. There is no deposit, no bond and no financial guarantee to provide.

11. Cost of the means of distance communication

Nothing beyond your usual connection. We apply no surcharge for using the internet to conclude the contract.

12. Codes of conduct

We are not bound by any code of conduct.

13. Licence

Buying does not transfer ownership of the sounds. It grants you a licence, the full text of which is published on this website and included in every archive as LICENCE.txt.

Read it before you buy: it is public and requires no payment to consult.

14. Complaints and mediation

Send your complaint in writing first to hello@sendreturnstudio.com. We answer within 5 working days.

If our answer does not satisfy you, or if we have not answered within two months, you may refer the dispute free of charge to our consumer mediator:

This contract is governed by French law.

If you live in another country, this does not deprive you of any mandatory protection granted to you as a consumer by the law of your country of residence.
